WEATHER UNDERGROUND API TERMS AND CONDITIONS OF USE
The Weather Underground Application Programming Interface (the "API") is owned and operated by Weather Underground, Inc. ("WUI"). If you use the WUI API, you will be able to pull and to decode weather related data from the non-public website of WUI. Listed below are the terms and conditions of use (the "Terms") for this API. By using, accessing and/or viewing information on the API, you agree to be bound by these Terms. If you violate these Terms, WUI has the right to terminate your use of the API and/or take appropriate legal actions against you. We reserve the right to change these Terms at any time by posting on the WUI API website.
- ACCEPTANCE OF TERMS. In order to use the API you must agree to these Terms. You agree that you have read and agree to these Terms by clicking the “Yes, I Agree” button located on the sign on page.
You represent that you have the full power, capacity and authority to accept these Terms. If you are accepting on behalf of a business entity, you represent that you have the full legal authority to bind the business entity to these Terms.
- PERMITTED USE. You may access, view and make copies of the data in the API for your personal or commercial use. Due to the special features of API, by accessing and viewing information from API you agree to be bound by these special terms:
(a) you will not modify the data from API in any way;
(b) you will not modify the link structure to API;
(c) you will not modify WUI's logo that is included in the data;
(d) in all uses of the data, you will credit WUI by name and brand logo as the source of the data.
Subject to these Terms, WUI gives you a personal, worldwide, non-assignable and non-exclusive license to the API.
- RESTRICTIONS. You may not:
(a) display the API in any manner that implies a relationship or affiliation with, sponsorship, or endorsement by WUI or that can be reasonably interpret to suggest content represents the views or opinions of WUI.
(b) use the API to disparage WUI or its products.
(c) use the API on your website if the website promotes illegal activity, contains pornography, gambling, or the sale of tobacco or alcohol to individuals under the age of legal consumption.
(d) delete or alter any trade names, trademarks, service marks, logos, domain names or other distinctive brand features of WUI that are included in the API in applications or programs that you create.
(e) reverse engineer, decompile or otherwise attempt to extract the source code of the API or any part thereof, unless this is expressly permitted or required by applicable law.
- RATE LIMITS AND MONITORING. There is a daily limit and minute rate limit to the number of requests that can be made to the API for free. You may exceed this threshold only if becoming a fee paying subscriber. WUI will monitor your daily usage of the API to determine if you have exceeded the free-use threshold by using an application programming interface key (the “Key”). Refer to the “Key Settings” page for product pricing, package features, and rate limit levels.
- DEFINITION OF A DAY AND MINUTE FOR RATE LIMITS. A day will be defined by the 24 hour period from Midnight to Midnight in New York City local time (either EDT or EST depending on the time of year). A minute will be defined by a 60-second period of time on the WUI servers’ internal clock.
- RAINDROP FEATURE. As a customer service feature, WUI will grant forgiveness for rate limit overages by way of the ‘Raindrop’ tool. Raindrops are 'credits' that can be used to cover overages of use to avoid ‘denial of service’ responses.
Free raindrops Policy:
- Each Key account will be initialized with 3 Raindrops
- Each Key will have one new Raindrop added to its account every Sunday on Midnight, New York City Local Time (either EDT, or EST).
- If a minute or daily rate limit is exceeded then a Raindrop is deducted from the account of the Key to 'forgive' the overuse.
- If all of an API Key's raindrops have been depleted and a rate limit is exceeded, then "Request Denial - Surpassed rate limit" errors will occur for each overage for the remaining period of the day or minute where the rate limit was exceeded.
Raindrop Rewards:
- A Key will be gifted one raindrop for every 2500 clicks-backs that a Key sends to a www.wundergound.com page. Refer to the WUI API technical documentation page for instructions for how to insert an API key into the URL that directs to www.wunderground.com.
- OWNERSHIP/TRADEMARKS. You do not acquire or have any ownership, license or other proprietary interest in the API. You understand that the API is protected by copyrights, trademarks, service marks, patents and other proprietary rights and laws.
- PRIVACY POLICY. The use of personal information is governed by our Privacy Policy of WUI’s general Terms and Conditions of Use.
- LIMITATION OF LIABILITY. WUI assumes no responsibility for, and shall not be liable for, any damages or expenses you may incur as a result of any inaccuracy, incompleteness or obsolescence of anything contained in the API. THE SERVICES OF THE API ARE PROVIDED “AS IS”, WITH NO WARRANTIES WHATSOEVER. Without limiting the generality of the forgoing, you agree that neither WUI nor any of its affiliates, employees or agents will be liable to you or to any other party for any direct or indirect damages, or for any special, exemplary, punitive, incidental, consequential or other damages (including, but not limited to, lost profits or lost time), whether based on contract, tort, strict liability or otherwise, which arise out of or are in any way connected with any access to the API or any viewing or use of any information on the API. You acknowledge that the limitations in this Section are reasonable and appropriate. WUI DISCLAIMS ALL WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, CURRENCY OR RELIABILITY OF THE DATA IN THE API, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR OTHERWISE ARISING BY LAW OR STATUTE. YOU AGREE THAT YOUR USE OF, OR RELIANCE UPON, ALL DATA OBTAINED THROUGH THE API IS AT YOUR OWN DISCRETION AND RISK.
- UNAUTHORIZED USE/NO INTERFERENCE. You agree that you will not use or attempt to use any method, device, software or routine to harm others or interfere with functioning of the API or use and/or monitor any information in or related to the API for any unauthorized purpose.
By using the API in applications or programs you create, you agree to be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm (including but not limited to harm caused by spyware, malware, worms, Trojan horses and viruses) resulting from such application or program.
- INDEMNIFICATION. You agree to indemnify and to hold WUI, its subsidiaries, affiliates, business partners, officers, employers and other agents, harmless from and against any loss, liability, damage or expense (including reasonable attorneys fees) arising out of your use of the API, including, without limitation, any violations by you of these Terms.
- TERMINATION. Without limiting its other remedies, WUI may immediately discontinue, suspend, terminate or block your and any user's use of the API at any time in its sole discretion. You may terminate this agreement by ceasing to use the API or any product incorporating it.
WUI may in its sole discretion choose to upgrade the current version of the API at any time without notice to you, which may make the version of the API that you are using obsolete.
When this legal agreement comes to an end, those Terms that by their nature are intended to continue indefinitely will continue to apply, including but not limited to Sections 5, 7, 8, 9, 13 and 14.
- ACCURACY OF INFORMATION. ALL INFORMATION IN THE API IS PROVIDED TO YOU ON AN "AS-IS" BASIS. YOU ACKNOWLEDGE THAT REPORTS, FORECASTS AND OTHER INFORMATION REGARDING WEATHER AND CLIMATIC CONDITIONS ARE UNCERTAIN. WUI DISCLAIMS ALL WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, CURRENCY OR RELIABILITY OF ANY INFORMATION IN THE API, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR OTHERWISE ARISING BY LAW OR STATUTE.
- TRANSMISSION FAILURES. WUI will use commercially reasonable efforts to publish and transmit the API on a continuous and timely basis. WUI is not, however, responsible for any failure or malfunction in communications; for any failure or refusal of any third party transmission intermediaries to transmit any API; or for the failure to transmit any API resulting from any natural disasters, wars, labor strike or other events beyond the control of WUI. YOU ACKNOWLEDGE THAT, IN CIRCUMSTANCES INVOLVING NATURAL DISASTERS, FEDERAL, STATE AND MUNICIPAL GOVERNMENTAL AGENCIES WILL ISSUE OFFICIAL WEATHER WATCHES, WARNINGS, ADVISORIES, BULLETINS AND SIMILAR COMMUNICATIONS.
- LIMITATION OF LIABILITY. You acknowledge that, WUI cannot and does not assume any responsibility for, and shall not be liable for, any damages or expenses you may incur as a result of any inaccuracy, incompleteness or obsolescence of any information contained in the API. You agree that WUI will not be liable to you or to any other party for any direct or indirect damages, or for any special, exemplary, punitive, incidental, consequential or other damages (including, but not limited to, lost profits or lost time), whether based on contract, tort, strict liability or otherwise, which arise out of or are in any way connected with any access to the API or any contractual or other dealings or relationships you may have with third parties based upon any information included in the WUI.
- GOVERNING LAW/JURISDICTION. These terms and conditions and your access to and use of information from the API are governed by the laws of the State of Michigan. In the event of any dispute regarding the interpretation or compliance with these terms and conditions, you consent to the exclusive jurisdiction of the state and federal courts located in Washtenaw County, Michigan.
- ENTIRE AGREEMENT. These terms and conditions of use for this API constitute the entire agreement between you and WUI regarding your access to the API and your reproduction and use of any information in the API. Any waiver of any term or condition shall not be effective unless in a written document signed by an authorized representative of WUI.
PRIVACY POLICY
The information Weather Underground learns from its visitors helps it personalize and continually improve your browsing experience. This policy lists the types of information gathered from Weather Undergrounds website (the Website).
Weather Underground may automatically collect information from users when they visit the Website. Examples of the information that may be automatically collected and analyzed include the Internet protocol (IP) address used to connect your computer to the Internet; login; email address; password; computer and connection information such as browser type, version, and time zone setting, favorite cities list, metric vs. English measurement preference, language preference, browser plug-in types and versions, operating system, and platform; purchase history, which may be aggregated with similar information from other customers; the full Uniform Resource Locator (URL) clickstream to, through, and from the Website, including date and time; cookie number; and products you viewed or searched for. Weather Underground may also use browser data such as cookies, Flash cookies (also known as Flash Local Shared Objects), or similar data on certain parts of the Website for fraud prevention and other purposes. During some visits Weather Underground may use software tools such as JavaScript to measure and collect session information, including page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page.
All information acquired from online sales through the Weather Underground store is used only for Weather Underground's internal billing purposes and will not be made available to any outside party except as is necessary to complete a sale.
Weather Underground will never make available to the public any personal information that Weather Underground acquires from a user such as name, telephone number, address or email address except in matters of criminal or governmental investigations or pursuant to a court order. Weather Underground may release account and other personal information when Weather Underground believes release is appropriate to comply with the law and to protect the rights, property, or safety of Weather Underground, the Websites users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction. This does not include selling, renting, sharing, or otherwise disclosing personally identifiable information from customers for commercial purposes in violation of the commitments set forth in this Privacy Policy.
Weather Underground does not track the preference cookies that users place on their machines.
Weather Underground may place a cookie on a users machines that is used for counting how many unique users are actively using the Website. Aggregate statistics may be compiled to determine how many unique users and average page views the Website has.
Aggregate statistical information gathered via the Weather Underground's "Wunder Question" may be shared with the public. Weather Underground will not make anyone's individual answers to these polls publicly known.
Weather Underground's advertising is targeted based on content and interest. Weather Underground uses third-party advertising companies to serve ads when you visit the Website. These companies may use information (not including your name, address, email address, or telephone number) about your visits to this and other websites in order to provide advertisements about goods and services of interest to you.
Google, as a third-party vender, uses cookies to serve ads on the Website. Googles use of the DART cookie enables it to serve ads to you based on your visit to Weather Underground's Website and other websites on the Internet. Users may opt out of the use of the DART cookie by visiting the Google ad and content network privacy policy.
If you want to prevent a third-party advertiser from setting and/or reading cookies on your computer, you may either visit each ad network's website individually and opt out or visit the NAI gateway opt-out site to opt-out of all network advertising cookies. It is important to protect against unauthorized access to your password and to your computer. Be sure to sign off when finished using a shared computer. Weather Underground will not be held responsible for lost or stolen usernames or passwords.
